BoosterX End-User License Agreement (EULA)

1. General Provisions
- This Agreement is accepted when the User (a) clicks “I accept,” (b) downloads or installs the Software, or (c) activates an activation key.
- Amendments & notice. The Right Holder may update this EULA but will (i) publish the new version at boosterx.org/useragreement and (ii) e-mail all registered Users at least 14 calendar days before the changes take effect. The User may reject the update and receive a pro-rata refund for any unused prepaid period.
- Use of the Software is allowed only under this Agreement. If you disagree, do not use the Software.
- If any clause is held invalid, the remaining clauses stay in force.
- The Program’s algorithms and source code are trade secrets of the Right Holder. Unauthorized use voids the license.
2. Terms & Definitions
- Program / Software — “BoosterX,” a Windows-optimization utility designed to automate system tuning for better performance.
- Account — User profile created in the Program or on the Site.
- Site — boosterx.org and its sub-domains.
- Server — hardware infrastructure operated by the Right Holder.
- User / You — an individual who accepted this EULA.
- Activation Key — an alphanumeric code of 42 or more characters that unlocks PRO features.
3. Subject of the Agreement
- The Right Holder grants a non-exclusive, non-transferable, worldwide license for the paid term and scope.
- This license covers all updates released during the term.
- All intellectual-property rights remain with the Right Holder.
4. Scope of the License
- One Key → one physical PC. Hardware IDs (CPU, GPU, motherboard serials, etc.) are used for binding; reinstalling Windows does not consume another activation.
- Keys with a 1-year or Lifetime term include one free unbind every 6 months via the in-app button “Manage Key.”
- The User may change any setting exposed in the GUI.
- The User shall not:
- reverse-engineer, decompile, or disassemble the Software;
- use it for unlawful purposes;
- redistribute copies or make the Software publicly available;
- introduce malware or bypass technical protection;
- probe BoosterX servers without prior written consent.
- User-generated backups / presets belong to the User; anonymized telemetry belongs to the Right Holder.
5. Data Processing & Privacy
Collected automatically (licensing)
- Hashed hardware ID (CPU / GPU / MB);
- User e-mail (for key binding);
- Public IP address (anti-fraud);
- Anonymized crash stack-trace (only if the App crashes).
AI Assistant (TweaX) — optional
When you use the AI prompt features, your prompt and limited technical context are sent securely to:
- OpenAI API — retains inputs/outputs for up to 30 days solely for abuse monitoring and does not use them to train models.
- DeepSeek API — stores chat logs and device info as described in its privacy policy and may disclose data to its corporate group or law-enforcement as required.
You can disable AI features in Settings → “TweaX AI.”
AI Optimization Analysis
When optimization analysis is initiated, the following ephemeral data are transmitted to the AI module (OpenAI/DeepSeek) only:
- Hardware specifications and current CPU/GPU load;
- Display resolution;
- List of running processes (to detect bloatware);
- Already applied tweaks and system settings.
These data are not stored by the Licensor and are used solely for a one-time calculation of optimization recommendations.

6. Rights & Obligations
6.1 Right Holder may:
- verify compliance (integrity checks, encrypted diagnostics);
- release mandatory security updates;
- adjust prices and run promotions;
- temporarily suspend service for maintenance (24-hour notice, except emergencies);
- process personal data strictly under Section 5.
6.2 Right Holder shall:
- e-mail the Activation Key within 5 minutes of cleared payment;
- maintain reasonable server security;
- provide support via [email protected].
6.3 User shall:
- maintain Internet connectivity and sufficient disk space;
- safeguard credentials and keys;
- review in-app warnings before applying tweaks;
- allow automated integrity checks (no personal files are scanned);
- keep a backup of important data.
6.4 User may:
- unbind an eligible Key via “Manage Key” inside the Program;
- request support or a refund under Section 8;
- stop using the Software at any time.
7. Payment & Key Rules
- Prices and applicable taxes are shown at checkout.
- Key is sent within 5 minutes; if not received in 30 minutes, contact support.
- Key binds to the e-mail used at purchase and to hardware IDs.
- Key survives OS reinstalls but may be invalidated by spoofers or illegal Windows activators.
- To move the license to new hardware, unbind in-app via “Manage Key.”
8. Refund Policy — summary
- 14-day money-back guarantee, even after activation.
- After 14 days — refunds only for defective keys if no replacement is provided within 3 business days.

9. Third-Party Components
The Software interacts with Microsoft Windows APIs, Nvidia APIs, and AI services provided by OpenAI LLC and DeepSeek Inc. Trademarks belong to their respective owners. Changes in those external services may affect certain features; the Right Holder will make reasonable efforts to restore functionality but cannot guarantee uninterrupted operation.

10. Warranty & Liability
- The Software is provided “as is.” To the fullest extent permitted by law, all implied warranties are disclaimed.
- No liability for indirect or consequential damages unless caused by gross negligence or willful misconduct.
- Nothing limits liability for death, personal injury, fraud, or mandatory statutory obligations.
11. Termination
- Material breach (e.g., piracy) → immediate suspension without refund.
- Other breaches → written notice and a 5-day cure period.
- Service discontinuation by the Right Holder → 30-day notice and pro-rata refund for unused prepaid time.
12. Dispute Resolution
- Step 1 — good-faith e-mail negotiation.
- Step 2 — if unresolved, disputes are submitted to the court of the Right Holder’s domicile unless consumer law provides otherwise.
13. Governing Law
This Agreement is governed by the substantive law of the Russian Federation; mandatory consumer protections of the User’s country apply where required.
